HB62 Summary

• Amends Alabama Code Section 37-15-2 to expand the definition of "excavate or excavation" under the One-Call Notification System law.

• Excludes routine roadway maintenance activities from the definition of excavation when performed by state or local government employees, contractors, or those responsible for publicly-maintained roadways within the right-of-way.

• Excludes routine railroad maintenance activities conducted within track structures and adjacent rights-of-way when performed by railroad employees or contractors, provided activities are carried out with reasonable care to protect underground facilities.

• Clarifies that maintenance work done by government employees without advance plan drawings or detailed scheduling does not require One-Call Notification System procedures.

• Becomes effective on the first day of the third month following passage and approval by the Governor.
