HB 643 Summary

• Amends Section 32-2-83 of the Code of Alabama 1975 to authorize the Secretary of the Alabama Law Enforcement Agency to dispose of agency vehicles and equipment through public auction or negotiated sale to other state departments or agencies.

• Requires public auctions to be advertised for at least two weeks in advance with advertisements appearing once weekly for two consecutive weeks in a newspaper of general circulation in the county where the sale occurs.

• Establishes that sales made in violation of the bill's terms shall be null and void, with violators subject to liquidated damages of $1,000 to $10,000 recoverable by the Attorney General through civil action in Montgomery County Circuit Court.

• Directs all proceeds from vehicle and equipment sales to be deposited into the Public Safety Fund in the State Treasury for use by the Alabama Law Enforcement Agency.

• Transfers all authority, power, duties, and responsibilities of legacy agencies under Chapter 27, Title 41 of the Alabama Code to the Alabama Law Enforcement Agency and authorizes the agency to apply for grants and accept lawful gifts and donations.
