Requires the judge of probate in Mobile County to conduct a referendum election at the 2016 general election asking voters to choose between keeping a three-member or expanding to a five-member county commission.

If voters select Question 1 (majority vote), the Mobile County Commission remains composed of three full-time county commissioners.

If voters select Question 2 (majority vote), the Mobile County Commission expands to five full-time county commissioners elected from single-member districts, effective at the next county commission election.

New commission members receive the same salary and benefits as prior commissioners, and the county must divide into five single-member districts of approximately equal population using the most recent federal decennial census.

The act applies only to Mobile County and becomes effective immediately upon passage and gubernatorial approval.
