Amends Section 23-1-26 of the Code of Alabama 1975 to remove the limit of five assistant counsel positions, allowing the Director of Transportation to appoint additional assistant counsel as needed for the department's legal business.

Changes language from "shall be authorized" to "may appoint" assistant counsel, with Attorney General approval and subject to state Merit System law.

Requires the Director of Transportation to consider racial, gender, geographic, urban/rural, and economic diversity of the state when appointing assistant counsel.

All appointed chief counsel and assistant counsel must be commissioned as assistant attorneys general and take the required oath.

Effective immediately upon passage and approval by the Governor or upon becoming law.
