SB188 Summary

• Adds Section 34-25A-7.1 to the Code of Alabama 1975 to grant the State Board of Prosthetists and Orthotists authority to issue subpoenas and compel witness attendance and production of documents in matters pending before the board or during complaint investigations.

• Authorizes subpoenas to be signed by the board chair or executive officer and served by sheriffs, the executive officer, or other authorized persons under Alabama Rules of Civil Procedure.

• Permits circuit court enforcement of board-issued subpoenas upon application by the board or its executive officer using the same procedures as circuit court subpoenas.

• Allows the board to establish rules for enforcement and disciplinary action, including civil fines, against licensees or practitioners who fail to comply with board subpoenas.

• Exempts hospitals, authorized health care practitioners, and persons employed by or contracted with hospitals or health care providers from these subpoena provisions; the act becomes effective immediately upon passage and gubernatorial approval.
