State agencies authorized to levy or assess fees that are retained for operations or programs may increase fees based on the Consumer Price Index for all urban consumers as published by the U.S. Department of Labor, Bureau of Labor Statistics.

Fee increases calculated from the end of December in the tenth year preceding the increase or from the end of December when the fee was last increased (whichever is shorter) to the end of the month preceding the effective date, rounded down to the nearest dollar.

Agencies may repeat the fee increase process every five years using Consumer Price Index data, with a maximum annual increase cap of two percent per year.

Any fee schedule change under this act is subject to the Alabama Administrative Procedure Act and any increase must be retained by the agency for its operations or programs.

Exemptions apply to the Alabama Public Service Commission, State Parks Division of the Department of Conservation and Natural Resources, and the State Banking Department.
