SB229 Summary

• Secretary of State shall develop an electronic program for business and nonprofit entity filings under Title 10A, Code of Alabama 1975, which may include online forms, recording, fee payment via credit/debit cards, and vendor contracting.

• Counties may voluntarily participate in the program through written agreement with the county commission, judge of probate, and Secretary of State, with either party able to terminate upon 120 days' written notice.

• Vendors must collect all recording fees and remit county-applicable fees and associated data to participating counties at least twice per month; cooperation between Secretary of State and counties incurs no additional cost.

• Participation in the electronic program satisfies all fee, filing, and statutory requirements for counties whether prescribed by general law, general law of local application, or local law.

• Judges of probate may continue providing filing services under current procedures and are not obligated to participate in the electronic system; act becomes effective on the first day of the third month following passage and approval.
