• Authorizes awarding authorities to use the construction manager/general contractor (CM/GC) method as an alternative to design-bid-build for public works projects exceeding $15,000,000 in anticipated construction costs.

• Excludes all contracts by the Alabama Department of Transportation and counties or municipalities for road or highway construction/maintenance from the CM/GC method.

• Requires CM/GC selection through prequalification and competitive proposals based on qualifications rather than lowest price alone; prohibits prior CM/GC experience on public projects as a qualification criterion.

• Limits CM/GC self-performance of work to 10 percent of guaranteed maximum price, with exceptions for subcontractor defaults or non-performance; requires competitive bidding for subcontracts exceeding $50,000.

• Establishes Class C felony penalties for willful violations; makes all proceedings and documents related to CM/GC contracting public records; effective October 1, 2016.
