SB28 Summary

• Amends Section 13A-7-22 of the Code of Alabama to enhance penalties for criminal mischief in the second degree when involving damage to a church or other religious building or property within such buildings.

• Requires a mandatory minimum sentence of not less than 10 days in jail upon a second conviction of criminal mischief in the second degree involving a church or religious building within a five-year period.

• Requires a mandatory minimum sentence of not less than 30 days in jail upon a third or subsequent conviction of criminal mischief in the second degree involving a church or religious building within a five-year period.

• Mandates that courts order restitution as a first priority before payment of fines, court costs, or other court-ordered payments in all convictions for criminal mischief in the second degree involving a church or religious building.

• Becomes effective on the first day of the third month following passage and approval by the Governor.
