SB283 Summary

• Amends distribution of hazardous waste disposal facility fees beginning October 1, 2015, providing 25% to counties with commercial hazardous waste disposal sites and 75% to the State General Fund with $450,000 annually earmarked for the Department of Environmental Management.

• Establishes a guaranteed annual payment of $4.2 million to qualifying counties (those with less than 25,000 population and a commercial hazardous waste site as of April 17, 1990), with remaining revenues split 50% to the state and 50% to the county after the guarantee is met.

• Requires counties to reimburse the State General Fund if state revenues were used to supplement county receipts to meet the $4.2 million guarantee, once county receipts exceed that threshold.

• Authorizes counties to levy additional fees on hazardous waste disposal operators through local law, and specifies that $.40 per ton of guaranteed funds shall be expended for health purposes.

• Takes effect upon passage and approval, with retroactive application to April 1, 2015.
