AL SB312

Establishes a $30 booking fee as court costs in St. Clair County against defendants convicted or pleading guilty in circuit or district court if booked or incarcerated in any county jail in the county.

Requires the court clerk to enter the booking fee on the docket sheet and collect it in the same manner and time as other court costs, with the fee assessed in addition to all other fines, costs, and charges.

Prohibits courts from waiving the booking fee unless all other fees, assessments, costs, fines, and charges associated with the case are also waived.

Mandates the court clerk remit collected booking fees monthly to the St. Clair County Commission for deposit in the county general fund to be used for construction of new county jail(s) and their subsequent maintenance and operation.

Becomes effective upon adoption of a local constitutional amendment applicable to St. Clair County authorizing the Legislature to provide additional court costs in the county.
