SB35 Summary

• Proposes a constitutional amendment allowing elected or appointed Lamar County officials, including the sheriff, to participate in the Employees' Retirement System instead of a supernumerary program or system.

• Prohibits new Lamar County officials from assuming a supernumerary office after the amendment's effective date, but grandfathers those already entitled to participate in such programs.

• Permits Lamar County officials holding office at ratification to purchase service credit in the Employees' Retirement System for their current service, but prohibits dual participation in both a supernumerary program and the retirement system for the same service.

• Excludes judges, district attorneys, legislators, constables, school board members, and officials elected from a judicial circuit from the amendment's scope.

• Requires an election held in accordance with Amendment 555 and state election laws, with ballot language describing the proposal; the amendment becomes effective upon official proclamation of ratification.
