SB38 Summary

• Amends Section 22-27-5 of the Code of Alabama 1975 to expand allowable uses of solid waste program fees and charges collected by county and municipal governments.

• Permits collected fees to be used for administrative services, maintenance and repair of buildings and roads or bridges used for solid waste services, and any other local government program that uses solid waste program services.

• Authorizes local governing bodies to collect delinquent solid waste fees through income tax refund set-offs in addition to existing methods of service suspension and civil action.

• Clarifies collection procedures for nonpayment of fees, allowing local governments to suspend services, collect debts through Article 3 of Title 40 Chapter 18, or bring civil actions to recover delinquent amounts with interest.

• Takes effect immediately upon passage and approval by the Governor.
