SB 405 Summary

• Adds hepatitis C virus (HCV) infection to the definition of "infected health care worker" alongside existing HIV and hepatitis B virus (HBV) infections for reporting purposes to the State Health Officer.

• Authorizes the State Board of Health to designate by rule other infectious diseases that require health care workers to report to the State Health Officer.

• Requires infected health care workers performing invasive procedures to notify the State Health Officer, and requires treating physicians to report infections in a time and manner prescribed by the State Board of Health.

• Establishes expert review panel procedures to evaluate infected health care workers who perform invasive procedures and recommend reasonable practice limitations to protect patients.

• Becomes effective on the first day of the third month following passage and approval by the Governor.
