SB406 Summary

• Creates the crime of homicide by vehicle or vessel when a person causes death while violating vehicle or boating operation laws, with a fine of $500-$2,000 and/or imprisonment up to 3 years.

• Amends Section 32-10-6 to change penalties for motor vehicle violations: Class A misdemeanor for property damage only; Class C felony for violations causing physical injury; Class B felony for violations causing death or serious physical injury.

• Defines "physical injury" and "serious physical injury" by reference to Section 13A-1-2 of Alabama law.

• Makes homicide by vehicle or vessel a strict liability offense and saves prior convictions and sentences issued before the effective date.

• Becomes effective on the first day of the third month following passage and gubernatorial approval.
