SB43 Summary

• Amends Section 16-6E-4 of the Alabama Code to clarify conditions triggering State Board of Education intervention in local school systems, including material noncompliance with state statutes or regulations and failure of a majority of students to meet state-approved academic benchmarks.

• Requires written notice of intervention to be issued to the local superintendent of education and the presiding officer of the local school system (instead of the city or county board presiding officer).

• Notice must specify deficiencies, required corrective steps, and a reasonable timetable for completion, with the local board having 21 calendar days to respond with reasons why intervention is unwarranted or a corrective plan.

• Grants the State Superintendent of Education plenary authority to make decisions and take actions to correct identified deficiencies, including personnel actions, if approved intervention proceeds.

• Takes effect immediately upon passage and gubernatorial approval.
