SB434 Summary

• Amends Alabama Code Sections 8-22-2, 8-22-4, 8-22-8, and 8-22-10 to clarify and simplify the Motor Fuel Marketing Act regarding combined sales of motor fuel and other goods.

• Removes the prohibition on businesses using profits from nonmotor fuel sales to subsidize below-cost motor fuel sales, eliminating one of three previously identified forms of unfair competition.

• Permits retailers to sell motor fuel combined with other goods when the combined selling price is not below the total cost to the retailer of all motor fuel and other goods included in the transactions.

• Allows combined sales to include both contemporaneous transactions and non-contemporaneous sales or series of sales, including where purchasers receive accrued discounts or credits on motor fuel from earlier purchases of other goods.

• Becomes effective immediately upon passage and approval by the Governor.
