SB5 Summary

• Amends Section 26-2A-107 of the Code of Alabama 1975 to extend the maximum duration for emergency temporary guardianship appointments from 15 days to 30 days.

• Allows a probate court to appoint a temporary guardian without notice when an incapacitated person has no guardian, an emergency exists, and no other person has authority to act.

• Temporary guardians appointed in emergency situations may exercise powers granted in the court order during the 30-day period.

• A separate provision allows appointment of temporary guardians for up to six months when a permanent guardian is not effectively performing duties and the incapacitated person's welfare requires immediate action.

• Becomes effective immediately upon passage and approval by the Governor.
