SB52 - Energy Security Act of 2015

• Grants incumbent electric suppliers the right to construct, own, operate, and maintain new electric transmission facilities (designed at voltages greater than 35,000 volts) that connect to their own electric systems.

• Allows incumbent electric suppliers to upgrade any electric transmission facilities they own within the state.

• Establishes that when a new transmission facility would connect to multiple incumbent electric suppliers' systems, each supplier has individual and proportional rights to the facility, subject to existing written agreements between them.

• Permits utilities to petition circuit courts in the jurisdiction where the transmission facility would be located to resolve disputes between incumbent electric suppliers over construction rights.

• Sunsets the statute on July 1, 2023, with a legislative committee required to report findings by January 1, 2023.
