AL SB97

Requires drivers involved in accidents with no apparent serious physical injury or death to move their vehicle from the roadway to the shoulder, emergency lane, or median if the vehicle is drivable and can be safely moved.

Authorizes Department of Transportation employees to move, require movement of, or assist in moving vehicles disabled by accidents from roadways under state jurisdiction if the disabled vehicle creates a traffic hazard or obstructs traffic and can be safely moved.

Prohibits movement of vehicles involved in accidents with apparent serious physical injury or death until directed by a law enforcement officer.

Provides immunity to drivers and other persons who move vehicles from roadways before law enforcement arrival, preventing them from being considered at fault solely for moving the vehicle or failing to stop and report the accident.

Makes Department of Transportation employees subject to Section 36-1-12 regarding damages or claims resulting from their authority under this section; became effective immediately upon passage and approval.
