HB183 - Ultrasound Access Act Summary

• Requires abortion providers to privately provide women with a current sonogram portraying the entire body of the unborn child at least 48 hours before performing an abortion, along with verbal description of relevant features and audible heartbeat if present.

• Mandates providers deliver written and oral information including probable gestational age, fetal development photographs in four-week increments, description of nerve development and pain ability at each stage, and potential child survival information.

• Requires providers to obtain written conflict of interest disclaimers detailing their gross income from abortions and potential monetary loss from the woman carrying the pregnancy to term.

• Establishes criminal penalties of up to 10 years imprisonment and fines up to $1,000,000 per violation for intentional, knowing, or reckless violations; allows aggrieved persons to sue for damages, punitive damages, treble damages, and attorney fees.

• Becomes effective immediately upon passage and approval by the Governor; exempted from Amendment 621 constitutional requirements as it defines a new crime.
