HB25 Summary

• Amends Section 15-5-8 of the Code of Alabama 1975 regarding execution of search warrants.

• For search warrants seizing property that does not include controlled substances, execution must occur during daytime unless the affidavit states the property is on the person or in the place to be searched.

• For search warrants seizing controlled substances, execution may occur at any time of day or night without restriction.

• The issuing judge or magistrate must specify in the warrant whether daytime execution or any time execution is authorized, based on the nature of the affidavits.

• The act becomes effective on the first day of the third month following passage and approval by the Governor.
