• Creates new crime of "harassment by distribution of a private image" as a Class A misdemeanor under Section 13A-11-8 of Alabama Code.

• Applies when person distributes, posts, emails, texts, or otherwise transmits a sexually explicit private image of another person without consent and with intent to degrade, harass, annoy, or alarm.

• Defines "private image" as photograph, digital image, video, film, or digital recording depicting sadomasochistic abuse, sexual intercourse, sexual excitement, masturbation, breast nudity, genital nudity, or other sexual conduct, including manipulated images.

• Distinguishes from existing harassing communications crime (Class C misdemeanor) by specifically targeting non-consensual distribution of intimate images with higher penalty classification.

• Takes effect on the first day of the third month following passage and gubernatorial approval or becoming law.
