HB255 Summary

• Amends Section 8-20-4 of the Alabama Code to add a new exemption to unfair and deceptive trade practice rules for certain manufacturers and distributors.

• Exempts manufacturers or distributors that manufacture or distribute engines for installation in vehicles with a gross weight rating exceeding 16,000 pounds from restrictions on owning or operating dealerships and repair facilities.

• The exemption requires that the manufacturer does not otherwise manufacture motor vehicles, owned or operated a facility in the state prior to January 1, 2016, does not own more than three dealership or repair facilities in the state, and does not regularly service non-commercial passenger vehicles weighing less than 16,000 pounds.

• Requires exempt manufacturers to provide dealers with equal access to repair support materials including parts, training, technical bulletins, and information to avoid reducing or eliminating competition.

• Becomes effective the first day of the third month following passage and approval by the Governor.
