HB26 Summary

• Amends Section 7 of Act 248 (1975) to maintain the $9 special index fee collected by the judge of probate for each real and personal property instrument filed for record in Shelby County.

• Allocates the $9 fee as follows: $5 for probate office equipment and operational costs, $2 for the Shelby County Constituents' Office (managed by the chair of the Shelby County Legislative Delegation), and $2 for county mental health programs (administered by the judge of probate).

• Requires all special index fees to be deposited into the county treasury and credited to a special fund, with the fee mandatory before any instrument can be recorded.

• Permits excess fees collected beyond implementation needs to be expended for probate office operations at the judge of probate's sole discretion.

• Becomes effective on the first day of the third month following passage and approval by the Governor.
