HB340 Summary

• Amends Section 16-64-2 of the Code of Alabama 1975 to classify Alabama National Guard members as resident students eligible for in-state tuition rates at public institutions of higher education.

• Adds two new pathways for National Guard members to qualify for resident tuition: minor dependents whose supporting person is a National Guard member (effective immediately upon passage), and adult non-minors who have been members for at least two years (effective May 22, 2012).

• Requires National Guard members to maintain continuous membership while enrolled to retain resident tuition status.

• Directs boards of trustees at each public institution of higher education to adopt rules and guidelines necessary to implement the amended section.

• Becomes effective on the first day of the third month following passage and approval by the Governor.
