HB45 Summary

• Creates the Unborn Infants Dignity of Life Act to allow parents of deceased unborn infants to request release of bodily remains for dignified final disposition through burial, interment, or cremation at their own expense.

• Prohibits the sale, transfer, or exchange of compensation for bodily remains of deceased unborn infants and prohibits providing payment for removal, storage, processing, transportation, or disposition of such remains.

• Prohibits use of living or deceased unborn infants or fetal tissue, organs, and bodily remains in research or experimentation, with exception for donations under the Revised Uniform Anatomical Gift Act.

• Establishes criminal penalties: Class D felony for knowingly accepting compensation for fetal remains or providing payment for disposition; Class C felony for experimenting on unborn infants or performing abortions where bodily remains may be used for research.

• Provides civil remedies for parents including money damages for psychological injuries and statutory damages equal to three times the cost of delivery or abortion, and authorizes professional disciplinary action against health care providers for violations.
