HB69 Summary

• Amends Alabama Code Sections 35-8B-1, 35-8B-2, and 35-8B-3 to create two additional types of community development districts (subsections (e) and (f)) located in wet counties that do not authorize Sunday sales of alcoholic beverages.

• Subsection (e) defines a commercial district with a restaurant (120+ seat capacity), grocery-delicatessen, riding stables and trails, community information center, and outdoor programming activities.

• Subsection (f) defines a commercial district with a restaurant (120+ seat capacity) adjacent to a marina with at least 34 boat slips, where the marina and restaurant are under common ownership.

• Upon Board of Control approval, on-premises Sunday sale of alcoholic beverages is authorized in these new districts, with licensees permitted to sell to persons licensed by the Alabama Alcoholic Beverage Control Board.

• Establishes a one-time filing fee of $500 payable to the county for districts formed under subsections (e) or (f); becomes effective the first day of the third month following passage and approval.
