SB12 Summary

• Establishes civil forfeiture of all property used in, intended for, derived from, or realized through conduct violating Alabama's terrorism statutes (Article 7, Chapter 10, Title 13A).

• Authorizes persons injured by terrorism offenses and law enforcement agencies involved in investigation, prosecution, seizure, or forfeiture to file claims with the Alabama Board of Adjustment for costs or damages from forfeited property.

• Allocates forfeited proceeds in priority order: investigation costs to law enforcement agencies first, then 25 percent of proceeds (plus prosecution costs) to prosecuting attorney, then remaining proceeds to satisfy judgments for injured persons on a pro rata basis.

• Allows injured persons to sue terrorism offenders for three times actual damages or $10,000 (whichever is greater) plus attorney's fees, with a five-year limitation period from discovery of the violation.

• Effective on the first day of the third month following passage and approval by the Governor.
