SB127 Summary

• Amends Section 13A-8-1 of the Code of Alabama to add definition of "fifth wheel" as the coupling between a trailer and a vehicle used for towing.

• Creates new crime of cargo theft (Section 13A-8-3.1) for knowingly obtaining unauthorized control over commercial transportation vehicles, trailers, containers, or their cargo with intent to deprive the owner, with penalties ranging from Class A misdemeanor ($500 or less) to Class A felony (exceeding $100,000).

• Creates new crime of fifth wheel tampering (Section 13A-8-3.2) for modifying, altering, or selling modified fifth wheels with intent to commit cargo theft, classified as a Class C felony.

• Allows disqualification from driving commercial motor vehicles for one year on first cargo theft conviction and for life on subsequent convictions, subject to possible reduction under Section 32-6-49.11.

• Effective on the first day of the third month following passage and approval by the Governor.
