SB13 - Alabama Heritage Preservation Act of 2016

• Prohibits relocation, removal, alteration, renaming, or disturbance of monuments located on public property unless a waiver is granted by the Permanent Joint Committee on Alabama Monument Protection.

• Extends the prohibition to schools, streets, bridges, buildings, parks, preserves, or reserves on public property that have been named or dedicated to commemorate events, persons, groups, movements, or military service.

• Creates the Permanent Joint Committee on Alabama Monument Protection with 7 members appointed by the Governor, Lieutenant Governor, Speaker of the House, and President Pro Tempore of the Senate to review waiver petitions.

• Requires entities seeking waivers to complete a deliberative process including a resolution, 8 weeks of public notice and signage, two public hearings, and written petition summarizing public input, certified by the Alabama Historical Commission.

• Imposes a $100,000 fine per violation for entities removing monuments without obtaining a waiver from the committee; exempts museums, archives, libraries, universities, and monuments controlled by the Department of Transportation or utilities when necessary for infrastructure operations.
