SB135 Summary

• Clarifies that the state preempts all regulation of firearms, ammunition, and firearm accessories, including taxation, purchase, sale, transfer, manufacturing, ownership, possession, use, storage, and transportation.

• Prohibits counties and municipalities from imposing user fees, special fees, or additional restrictions related solely to firearm, ammunition, or firearm accessory ownership or use.

• Prevents sheriffs from imposing user fees, special fees, or additional requirements for pistol permit issuance beyond those enumerated in Section 13A-11-75.

• Permits counties and municipalities to impose generally applicable sales taxes on firearms and ammunition at the same rate as other goods, but not at a higher rate.

• Becomes effective on the first day of the third month following passage and approval by the Governor.
