SB218 Summary

• Amends Section 11-40-10 of the Alabama Code to require an affirmative vote by the municipal governing body before extending police jurisdiction beyond corporate boundaries after the effective date of this act.

• Preserves existing police jurisdiction boundaries for municipalities as of the effective date; the affirmative vote requirement applies only to future extensions.

• Requires municipalities to provide 30-day notice before enforcing ordinances adopted after September 1, 2015, in police jurisdictions, with notice submitted to Atlas Alabama website if available at no cost.

• Establishes that police jurisdiction alterations from annexation or deannexation after September 1, 2015, take effect on January 1 and must be preceded by October 1 finalization, with annual boundary maps required to be submitted to the state.

• Allows municipal governing bodies to elect by resolution not to exercise jurisdiction or authority, including tax assessment, in portions of police jurisdiction extended through noncontiguous property annexation.
