SB300 Summary

• Defines "manufacturing" for biological and bacteriological weapons as the mixing or combining of two-part binary products, and modifies the definition of incendiary substances.

• Creates the crime of unlawful manufacture of a destructive device or bacteriological or biological weapon in the second degree as a Class B felony for unauthorized manufacture or possession of precursor substances with intent to manufacture.

• Creates the crime of unlawful manufacture of a destructive device or bacteriological or biological weapon in the first degree as a Class A felony when the second degree crime occurs in conjunction with two or more aggravating conditions including booby traps, hazardous materials, proximity to residences/schools, actual production, or presence of minors under 17.

• Authorizes the State Fire Marshal to adopt rules establishing qualifications, application procedures, and fees for permits to lawfully manufacture destructive devices or biological weapons, with 30-day review period and one-year permit expiration.

• Becomes effective on the first day of the third month following passage and approval by the Governor.
