SB317 Summary: Revised Uniform Athlete Agents Act

• Repeals the 2001 Uniform Athlete Agents Act and enacts the Revised Uniform Athlete Agents Act (2016), continuing registration of athlete agents by the Alabama Secretary of State with updated requirements and procedures.

• Requires athlete agents to register with the Secretary of State ($200 initial fee, $100 renewal fee) and allows reciprocal registration for agents registered in other states with substantially similar requirements; registration valid for two years.

• Mandates athlete agents notify educational institutions within 72 hours before contacting student athletes and requires student athletes and agents to notify athletic directors within 72 hours of signing agency contracts; agents cannot initiate contact without prior institutional notification.

• Establishes civil remedies allowing educational institutions and student athletes to sue athlete agents for damages resulting from violations, with prevailing plaintiffs recovering actual damages, costs, and attorney's fees; agents must forfeit payment and refund consideration provided to athletes.

• Creates criminal penalties ranging from Class A misdemeanor to Class B felony depending on violation severity and registration status; establishes Alabama Athlete Agents Commission with 18 appointed members overseeing regulation and enforcement; takes effect October 1, 2016.
