• Defines dismemberment abortion as purposely dismembering a living unborn child and extracting fetal parts piece by piece using clamps, forceps, scissors, or similar instruments; excludes suction aspiration methods.

• Allows accused individuals to request a hearing before the State Board of Medical Examiners to determine if the abortion was medically necessary, with findings admissible in court proceedings.

• Establishes civil causes of action for injunctive relief and damages (including actual damages plus statutory damages equal to three times the abortion cost) maintainable by the woman, spouse, parent, guardian, or healthcare provider.

• Creates criminal penalties of up to $10,000 fine and/or up to two years imprisonment for violations; provides attorney fee awards to prevailing parties and protects anonymity of women in proceedings.
