SB6 - Alabama Heritage Preservation Act of 2015

• Prohibits relocation, removal, alteration, renaming, or disturbance of commemorative statues, monuments, memorials, or plaques on public property, and prohibits relocation of grave sites with historical significance.

• Requires governmental entities seeking to alter or remove such objects to petition the Alabama Legislative Council for a waiver through a deliberative process including two public hearings, eight weeks of newspaper advertisements, and certification by the Alabama Historical Commission.

• Authorizes the Alabama Legislative Council to grant waivers with reasonable conditions to preserve objects and allows the Council to deny waiver petitions.

• Imposes a fine of $100,000 per violation on governmental entities that remove objects without obtaining a waiver; fines are collected by the Attorney General and deposited into the State General Fund.

• Exempts museum collections, art and artifacts, the State Department of Transportation, and county/municipal highway departments when objects interfere with public transportation system construction or maintenance, though entities must strive to preserve such objects to the greatest extent possible.
