SB74 Summary

• Amends Section 8-32-2 of the Alabama Code to define "road hazard" as a hazard encountered while driving a motor vehicle, including potholes, rocks, wood debris, metal parts, glass, plastic, curbs, and composite scraps.

• Adds four specific service contract coverages for road hazard damage: repair or replacement of tires and wheels, paintless dent removal, windshield repair or replacement, and replacement of motor vehicle keys or key-fobs.

• Clarifies that service contracts may cover repairs to motor vehicles resulting from road hazard contact and specifies that windshield damage coverage is primary only when it exceeds the coverage offered by the vehicle owner's motor vehicle insurance policy.

• Becomes effective on the first day of the third month following passage and approval by the Governor.
