HB131 - Ultrasound Access Act Summary

• Requires abortion providers to privately provide women with a current sonogram portraying the entire body of the unborn child at least 48 hours before performing an abortion, including verbal description of relevant features and audible heartbeat if present.

• Mandates written and oral disclosure of additional information including probable gestational age with color photographs of fetal development, description of nerve endings and pain capability at each stage, survival potential, and a conflict of interest disclaimer from the abortion provider.

• Requires women to sign separate statements confirming the abortion provider complied with all disclosure requirements, and prohibits payment collection until 48 hours after the provider fulfills all initial disclosure provisions.

• Establishes penalties of up to 10 years imprisonment and fines up to $1,000,000 per violation for intentional, knowing, or reckless violations; allows civil actions for damages, punitive damages, treble damages, and attorney fees.

• Becomes effective immediately upon passage and approval by the Governor; provisions are severable and construed consistent with existing Woman's Right to Know Act.
