HB161 Summary

• Prohibits a person from owning, operating, or installing a false or secret compartment in a motor vehicle, aircraft, or vessel used to conceal controlled substances, illegal objects, or contraband.

• Creates a Class D felony offense for violations of the compartment prohibition.

• Permits seizure and forfeiture of any motor vehicle, aircraft, or vessel containing an illegal compartment, along with all contents within the compartment, subject to Alabama's forfeiture procedures under Code of Alabama 1975.

• Exempts new owners from criminal liability for prior violations if they had no knowledge of the illegal compartment and take steps to restore the vehicle to its original design.

• Becomes effective on the first day of the third month following passage and approval by the Governor.
