HB173 Summary

• Elevates assault in the second degree from a Class C felony to a Class B felony when committed with intent to prevent a peace officer, detention or correctional officer, emergency medical personnel, utility worker, or firefighter from performing lawful duty.

• Creates a new Class C felony for menacing when a person threatens a law enforcement officer with a pistol, firearm, or other deadly weapon; previously menacing was a Class B misdemeanor.

• Amends Section 13A-6-21 and Section 13A-6-23 of the Code of Alabama 1975 to establish enhanced criminal penalties for crimes against law enforcement and other specified public safety personnel.

• Becomes effective January 1, 2017, following passage and approval by the Governor.

• Excluded from Amendment 621 constitutional requirements because the bill defines a new crime or amends the definition of an existing crime.
