• Allows trial courts or the Director of Indigent Defense Services to waive the $4,000 maximum fee for appointed counsel in Class A felony cases for good cause shown when a case was tried to a jury verdict.

• Requires courts that waive the fee limit to enter a written order specifying the factors considered in determining the waiver was appropriate.

• Requires the Director to submit a written memo to the Department of Finance explaining factors considered for any waiver granted by the director.

• Establishes a cap that in no event shall total fees exceed twice the allowable fee for the original charge.

• Becomes effective on the first day of the third month following passage and Governor approval.
