HB258 Summary

• Amends Alabama Code Sections 13A-5-40 and 13A-5-49 to add prosecutors to the definition of law enforcement and expand enumerated capital offenses.

• Establishes the following as capital offenses: murder of a prosecutor; murder on a school campus (pre-K through higher education); and murder in a day care or licensed child care facility.

• Makes murder of a victim, juror, or family member a capital offense when committed to avenge, intimidate, or retaliate against the victim's role as a witness.

• Makes murder of a family member of law enforcement officers, prosecutors, judges, or correctional staff a capital offense when committed to avenge, intimidate, or retaliate for official actions.

• Adds a new aggravating circumstance for capital sentencing: intentional killing of a law enforcement officer while in the line of duty; bill becomes effective the first day of the third month after passage and approval.
