HB322 Summary

• Applies only to the City of Lincoln in Talladega County and authorizes Sunday sales of alcoholic beverages after 1:00 p.m. by properly licensed retail licensees, subject to city council approval by ordinance and voter approval by referendum.

• Allows city council to authorize earlier sales starting at 7:00 a.m. on Sundays when races are conducted at the international speedway in the county.

• City council may regulate which retail licensees may sell alcoholic beverages on Sunday and whether sales are for off-premises consumption.

• Requires the city to hold a referendum at the next regular election or a special election called for that purpose, with costs paid by the city; subsequent referendums cannot be held within 12 months of a failed referendum.

• Becomes effective immediately upon passage and approval by the Governor or upon otherwise becoming law.
