• Amends Section 12-19-43 of the Code of Alabama 1975 to allow probate court fees to be collected either when a pleading is filed or at the termination of the suit, at the court's discretion.

• Authorizes probate courts to order security deposits be deposited to cover expected court costs, with unused deposits returned to the depositing party.

• Maintains existing requirement that fees for transcript services must be paid when the service is performed and no fees may be charged unless the service has been completed.

• Becomes effective on the first day of the third month following passage and approval by the Governor.

• Passed by the House on February 23, 2017 and the Senate on May 2, 2017.
