HB373 Summary - Alex Hoover Act

• Creates the "Alex Hoover Act" allowing qualified representatives (parents, guardians, or adults acting in loco parentis) to develop palliative and end-of-life individual health plans for terminally ill minors (birth to age 19).

• Establishes a Physician Order for Pediatric Palliative and End of Life (PPEL) Care form to be developed by the Department of Public Health in conjunction with a Governor-appointed task force.

• Requires the State Board of Education to promulgate rules for palliative and end-of-life health plans in school settings, and requires the Department of Public Health to establish rules for plans outside schools, in consultation with relevant agencies.

• Provides civil and criminal immunity to physicians, health care providers, schools, school boards, and employees who in good faith follow the directives of a palliative and end-of-life individual health plan.

• Expands qualified minors' rights to execute advance directives for health care, consent to DNAR orders, and revoke advance directives through their qualified representatives.
