Amends Section 45-2-83.21 of the Code of Alabama 1975 to authorize the Judge of Probate of Baldwin County to collect a $5 special recording fee on each real property instrument, personal property instrument, and other documents filed for record in the probate office.

The $5 fee is mandatory and must be paid before any instrument can be received for record; the fee is in addition to all other applicable fees, taxes, and charges.

Collected fees shall be deposited into the Baldwin County treasury in a special fund credited to the judge of probate for discretionary expenditure on microfilming recorded documents and placing them on an electronic database including the Internet.

Removes the expiration date of September 30, 2010 that previously limited collection of $4 of the $5 fee, effectively making the full $5 fee permanent.

The act becomes effective immediately upon passage and approval by the Governor.
