HB471 Summary

• Amends Alabama Code Sections 39-1-5 and 39-2-2 to create an exception to public works bidding requirements for heating and air conditioning unit purchases and installations by counties, municipalities, and local school boards.

• Exempts HVAC contracts from standard public bidding if the purchase and installation are competitively bid through the National Association of Counties and National League of Cities purchasing cooperative (or successor organizations).

• Requires the Department of Examiners of Public Accounts to approve the cooperative's bid process before contracts can qualify for the exemption.

• Mandates that exempt contracts must be with Alabama vendors granted approved vendor status and that pricing must be equal to or less than state purchasing program rates when available.

• Becomes effective on the first day of the third month following passage and gubernatorial approval.
