HB5 Summary

• Enacted as the Kelsey Smith Act to require wireless communications service providers to provide call location information to law enforcement upon request in emergency situations.

• Authorizes law enforcement officers to request location information only when responding to emergency calls or situations involving risk of death or serious physical harm.

• Grants wireless service providers immunity from civil and criminal liability when providing location information in reasonable manner pursuant to this section.

• Requires all location requests to be in writing and signed by the requesting officer, or if made orally, documented and signed at the earliest possible time and retained as permanent records by the law enforcement agency.

• Permits law enforcement officers located in Alabama to monitor or obtain location information of devices from wireless providers regardless of the device's location, subject to federal law limitations.

• Directs Alabama State Law Enforcement Agency to obtain contact information from all wireless service providers authorized to do business in the state and disseminate it to state and local law enforcement agencies.
