HB56 Summary

• Amends Section 24-1-27 of the Code of Alabama 1975 to extend limited tort immunity to non-profit corporate affiliates of Alabama Public Housing Authorities that meet specified criteria.

• Qualifies corporate agents for governmental entity status and tort immunity protection under Chapter 93 of Title 11 when the housing authority's board serves as the corporate board and the executive director serves as president.

• Requires that organizational documents include provisions returning all public housing assets to the housing authority if controlling interest changes.

• Restricts the corporate agent's sole purpose to developing, owning, managing, operating, and maintaining low-income housing properties for the housing authority.

• Becomes effective on the first day of the third month following passage and approval by the Governor.
